National Retailer was alleged to have caused injuries to Plaintiff who fell and alleged negligence due to the presence of a shampoo or lotion spill. The Judge found that the retailer had no actual or constructive notice of the spill. The Judge also agreed that the doctrine of res ipsa loquitor as asserted by Plaintiff was not applicable under the facts as the injury could have occurred without the retailer’s negligence.
